Respondent agreed to pay disgorgement and interest as well as a $9,000,000 civil penalty to settle charges of disclosure failures and misleading statements to clients regarding investment advice it gave about mutual funds, illiquid alternative investments and cash sweep vehicles. This conduct allegedly concealed Respondent’s receipt of certain fees and revenue sharing, and caused clients to pay unnecessary fees.
